WORKERS'
COMPENSATION RETALIATION:
In Florida an employer may not
retaliate against an employee for pursuing a valid workers'
compensation claim. This prohibition is present in all states
in one form or another. A quick check of the laws in your home
state will provide the necessary requirements for bringing a
claim based on this theory.
RETALIATION
DISCRIMINATION:
An employer is prohibited from
retaliating against an employee who complains of discriminatory
behavior on the part of the employer or a co-worker, or who
refuses to participate in discriminatory behavior at the request
of the employer, or on behalf of the employer. Typically the
complaining employee's belief that discrimination has occurred
must be a reasonable belief.
WHISTLE BLOWING:
There is a federal law against
whistle blowing which provides protection against retaliation by
an employer if an employee speaks out against conduct on the
part of the employer which violates another law, rule or
regulation. The specifics of these laws from state to state may
differ, and so it is strongly recommended that these issues be
discussed with an attorney in your home state.
